BRUTON 2on2 Basketball Tournament

Introduction

1.      The “BRUTON 2on2 Basketball Tournament is organised and operated by Black Pearl Basketball Academy Pty Ltd(ABN 35 058 375 181).

2.      By participating in the Competition, individuals agree to the terms and conditions outlined below.

3.      All references to dollars or "$" are references to Australian dollars.

Eligibility

4.      The Competition is only available to persons who meet the following criteria:

a.      have registered for the Competition through the Competition Website (www.blackpearlbasketball.com.au) or at the door of the event and have paid the nominated registration amount ($55 per player, $110 per team)either before or on the day at the start of the event;

b.      Are 18 or above years old and if under eighteen (18) years old at the time of Registration must have parental/guardian approval to enter the Competition and further, the parent/guardian of the Eligible Competitor must read and consent to these Conditions.

How to Register and Compete


5.      Registration to participate in the Competition ("Registration") can be found online (www.blackpearlbasketball.com.au) and are open right up until the morning of the event date.

6.      To register to participate in the Competition, you must:

a. complete the required personal and payment details; and

b. confirm understanding of these Conditions in their entirety (including the Waiver Form (see below) which forms part of these Conditions)before submitting your Registration and payment. All details regarding Competition locations, times and requirements will be provided via email to your supplied email address.

7.      Once you have registered it will be your responsibility to monitor emails for information regarding the Competition. The Promoter (and any related entities of the Promoter) will take no responsibility for incorrectly entered email addresses or communication issues resulting in failed delivery of emails

8.      Register on the day of the event (must register before the start of the event) at the door. If you are under eighteen (18) years old then you will need a parent/guardian present time of registration to approve and sign the waiver document.

9.      Registrations will be open in four (4) different age groups (“Groups”) across two (2) different divisions ("Divisions"). Each Group and Division are as listed below:

DIVISION 1 - MALE
DIVISION 2 - FEMALE
   
AGE GROUP - Under 14, 15 - 20, 21 - 30 and 31 over.

10.      Registrations will be sorted into the above Divisions and Groups dependent on the information provided by you during your Registration.

11.      Groups will be determined by the date of birth of the person registering, whose age will be determined at the time of the commencement of the Competition.

12.      The under fourteen (14) Group will allow Registrations for competitors who are twelve (12) years or older. No Competitor who is younger than twelve (12) years old at the commencement of the Competition Period (see below) will be allowed to play unless approved by the promotors.

13.      Any Competitor registering that is younger than eighteen (18) years old at the time of the Competition will require permission from a parent, guardian or legal representative to compete and must be accompanied by said parent, guardian or legal representative to any and all Competition and Finals (see below) stages.

14.     To be eligible to compete in the Competition, all competitors will be required to provide proof of age (e.g. valid passport, driving licence, birth certificate (together with other identification document)) acceptable to the Promoter in its absolute discretion.  Any competitor who is not able to provide proof of age acceptable to the Promoter may forfeit their registration fee.  It is recommended that minors without photo identification provide, as a minimum requirement, their birth certificate together with photo identification for their accompanying parent, guardian or legal representative.

15.       The Promoter reserves the right to refuse to allow a competitor to compete in the Competition, if the Promoter determines, in its absolute discretion, that the Competitor is not in the mental or physical condition necessary to be able to participate safely in the Competition.

General Conditions

16.       Operation of the Competition is subject to event venue and ticket terms and conditions, including any applicable age restrictions. The Promoter, on behalf of itself; event venue and ticket organisers; and Prize providers, hereby expressly reserves the right to refuse entry to an event venue or the Competition, or participation in a Prize, to any person including a Competitor or Winner (and/or their companion/s) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the Competition or Prize.

17.       Any Competitor under the influence of illegal drugs or alcohol, or found to be consuming or in possession of illegal drugs or alcohol during the Competition, will be disqualified from the Competition without reimbursement of the registration fee or any other associated costs. Smoking will not be permitted inside the event venues or in the immediate vicinity of the event venues at which the Competition is being held and failure by Competitors to comply with smoking restrictions will result in disqualification from the Competition without reimbursement of registration fee or any other associated costs.  Failure by other persons to comply with smoking restrictions will result in refusal of entry for those persons to event venues.

18.       If for any reason the conduct or operation of the Competition is interfered with or disrupted in any way by a cause outside the reasonable control of the Promoter (including by vandalism, power failures, natural disasters, acts of God, civil unrest, strikes, tampering, computer bugs or viruses or technical failures), the Promoter reserves the right to cancel, terminate, modify or suspend or recommence the Competition without liability to any person, including persons who have submitted Registrations or Competitors.

19.       The Promoter has the sole discretion and final decision in determining whether any form of media should be posted on the Competition Website. Each Competitor, unless the Promoter advises otherwise, licenses and grants the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display such images, video footage, text and any other form of communication for any purpose in any media, without compensation, restriction on use, attribution or liability. Competitors agree not to assert any moral rights in relation to such use and warrant that they have the full authority to grant these rights.

20.       If a Competitor tampers with, or subverts, the processes relating to participation in the Competition, or may benefit from such tampering or subversion by any other person, the Promoter reserves the right in its sole discretion to disqualify that Competitor from the Competition. The Promoter reserves the right to verify the details of each Competitor, and request identification to establish their age or identity.

21.       The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communication line failures, theft or destruction or unauthorised access to, or alteration or non-receipt of yours or a Competitor's communications (including Registration process and information dissemination). The Promoter is not responsible for any problems or technical malfunctions (such as problems with telephone networks or lines, computer systems or software or internet service providers) or any failure of any internet communication or telephone communication to be received by the Promoter (whether as a result of technical problems or traffic congestion on any carrier network, on the internet or at any website). To the full extent permitted by law, the Promoter is not liable for any injury or damage to yours or any Competitor’s, or any other person’s computer or resulting from or otherwise relating to participation in the Competition (including by downloading materials relating to the Competition).

22.       CAUTION: ANY ATTEMPT TO CAUSE DAMAGE TO ANY WEBSITE OR THE INFORMATION ON ANY WEBSITE ASSOCIATED WITH THE COMPETITION OR TO CAUSE PHYSICAL DAMAGE TO ANY LOCATION OR PERSON ASSOCIATED WITH THE COMPETITION TO OTHERWISE UNDERMINE THE FAIR AND LEGITIMATE OPERATION OF THE COMPETITION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. THE PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW IN THE EVENT THAT ANY SUCH ATTEMPT IS MADE, WHETHER OR NOT THAT ATTEMPT RESULTS IN ANY SUCH DAMAGE, INTERFERENCE OR UNDERMINING.

23.       Unless otherwise stipulated, rights to receive any Prize are not transferable or exchangeable and cannot be taken as cash.

24.       All of the Promoter’s decisions are final and no correspondence will be entered into.

25.       The Promoter accepts no responsibility for any tax liability incurred as a result of any person winning a Prize. Competitors should obtain independent tax and financial advice.

26.       The Promoter is not responsible for any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with or utilised in the Competition which may occur in the course of the administration of the Competition.

27.       Any costs associated with accessing the Competition Website are the responsibility of the person seeking access and are dependent on the internet service provider used.

28.       To the fullest extent permitted by law, the Promoter, on behalf of itself and its related entities, (including Black Pearl Basketball Academy Pty Ltd (ABN 35 058 375 181)) and agencies and all those entities' personnel ("Relevant Parties") excludes all liability for any loss (including any damage, claim, injury, cost or expense) which is suffered or incurred by any person in connection with the Competition or any Prize, including: (i) any indirect, economic or consequential loss; (ii) any loss arising from the negligence of a Relevant Party; (iii) any liability for personal injury or death. Nothing in these Conditions is intended to exclude, restrict or modify a person’s rights which are not capable of being excluded under applicable law.

29.       The winners of a Prize consent to: (i) the Promoter using their name, likeness, image and/or voice (including any photograph, film and/or recording of the same) in any media worldwide for an unlimited period of time without remuneration for the purpose of promoting the Competition and/or the Promoter and its related entities; and (ii) the Promoter authorising its related entities to do anything that the winners consent to the Promoter doing under this condition.

30.       All Registrations become the property of the Promoter. Personal information provided by Competitors will be collected by or on behalf of the Promoter to enable it to administer and promote the Competition and the winners of the Competition. The personal information of Competitors may be provided to others assisting in the conduct of the Competition, including the Competition administrator, suppliers and deliverers, and to authorities that regulate the Competition. Individuals may contact the Promoter via the Competition Website or by emailing info@blackpearlbasketball.com.au to request access to, or corrections of, any of their collected personal information that is held by the Promoter. If a Competitor does not provide accurate personal information, the Promoter may determine that they are not eligible to win the Prize. Competitors acknowledge that their personal information may be supplied to organisations outside of Australia and they provide their consent for this to occur by participating in the Competition.

CANCELLATION AND REFUND POLICIES:

Competition Cancellation and Refund Policy

31.       A 15% cancellation fee will be incurred if you withdraw at any time after Registration

No refunds will be offered for withdrawals from the Competition received by the Promoter within 48 hours of the day of the event

All Registrations are non-refundable if registered within 48 hours of the day of the event. Registrations are non-Transferrable.

The Promoter reserves the right to complete any valid refund claims up to 45 days after the claim has been requested via the above email address.
